The USEPA (Unites States Environmental Protection Agency) has several exclusions in your heating oil storage tank needs to be federally regulated or not. If it used for simply the heating oil of the premise it is on then it is exempt from federal regulation.

Exemptions don’t cover, however, tanks that are used to hold oil for resale or local regulations. The USEPA has a nifty flow chart on their website that can answer any federal regulation standards you may need.
